'Herein lies the problem with that. Now that I’ve mentioned it, you’re now trying to make excuses. Enough is enough. Either the website comes down, or I contact my lawyers and the authorities and press charges. Such a claim that you can only “conclude” based on the information you were given is not enough to state that it is. Bear in mind that under the Criminal Code, making such a posting stating that something is fact and actually happened is liable, regardless of any “disclaimer” that you may post. Your website is nothing more than a defaming tabloid, which violates various different privacy laws, and as I have now been affected by this website of pure bull, I will be left with no other option but legal recourse should the content not be removed immediately.

Again you’re just assuming that it’s HIV, however you have no actual fact to document that. You’re also now trying to hide behind the “there are other articles” clause, which I find funny that your story has changed since I pointed that out. By publishing this page stating that it is, when in fact no conviction has or will be entered is defamation as there only ever was an allegation. I also suggest that you further do some research into defamation law as well as the terms of service of Host Gator, as one of the terms of service that they operate on in general is that it is against the terms of service to use their services for purposes of defamation, or to post illegal content. Both of these are exactly what you’re doing, as the entire point of your website is to defame people. Not to mention, your whole policy about not removing people’s names unless they submit a clean bill of health is preposterous as the Federal Privacy Act states that such materials are confidential, and it is therefore YOUR responsibility to prove such a claim, and not the responsibility of the defendant of the claim to prove the inaccuracy.

This is the LAST time I am going to demand that I am removed from your website under the penalty of legal action. I also must ask why if the whole purpose of your website is to “report” these things, then why aren’t you yourself listed on the website?

As for your whole disclaimer about “published source”, there’s a few problems with that. Said “published sources” state that it is ALLEGED that an event took place, however no proof has been provided as such information is incorrect. Your website on the other hand states that it happened for a fact, which in itself is NOT an accurate report of the information at hand. I also suggest that you look into your sources a little further, as clearly you have not done your homework on it, or you’d of realized a few inaccurate details on the posting itself. As your website only lists the Waterloo Regional Police website, which leaves out a lot of information that is posted on your website.

I must also point out that I’ve requested sources for every claim that you’ve made in that website, yet you have failed to satisfy this request. This only suggests to me that your website is nothing more than a tabloid with no regard for accurately reporting anything, as you obviously can’t seem to copy a press release correctly. REMOVE ALL REFERENCE TO ME FROM YOUR WEBSITE NOW!!!

Correction… The sited article that was posted makes no mention of me. The article that it sources now does not make any mention of HIV, however your article does very clearly state that. There are also a few other pieces of information that are missing from that article, however are posted on your website. Your website states that I have committed the act, when the fact of the matter remains I have not been convicted. Not to mention the fact that the source article states that it was a mere allegation. Again I am going to request that it be removed immediately.

While I am aware that even in your location the laws are different, there is one thing that does remain the same. All suspects are innocent until proven guilty in a court of law. I am hereby giving you a chance to correct this act of defamation, as I do not want to have to further get the lawyers involved.

'It has come to my attention that false information pertaining to myself has been publicly posted on your website (STDcarriers.com), and as such I am requesting that all record to my name be removed from your website immediately. Personally, I do not feel that such a posting method should even exist, as the information being submitted does not seem to be verified.

As your website has returned CGI errors pertaining to “not all headers were returned” as it was worded, I have felt it necessary to attempt to make contact through this method. Again I must request that all information pertaining to myself is removed from your website immediately.

If you're going to get on me about saying things with no proof, you should probably do the same for David. I don't really care for any of this, I'm an asshole and a troll, I love riling this kid up because he's a scumbag who brags about turning sociopathic on girls who reject him and because he's a drug addict.

You talk about how you want things to stay on topic, they won't, not as long as David's allowed to post comments. It's obvious he has herpes, so instead of providing proof, he's just lashing out at everyone. You can't blame anyone for defending themselves when he goes psychotic about it.

But as I stated before, I'm an asshole to people like him and troll them, I used to be co-owner of www.internetownage.com but the site went to shit. I used to write articles on some of the biggest failures on the net and get paid. Your site kinda reminds me of that..seems most of the people on there are scumbags who refuse to tell their partners they have an STD.

'I'm tired of this. You know those posts were dated before you even brought up IP addresses to me. I think I see what is going on here. Look, I don't have genital herpes. I've never tested positive for it. Only blister I ever had down there tested negative...and for some reason that isn't proof to you. If this attorney I'm meeting on thursday wants to take my case, I'm looking at a few grand I guess to get everything accomplished. How much do you want? Seriously. Anything under that 3000 mark and I guess I'll be saving money. This is killing my life and stressing me out to no end, dealing with my friends finding this site...arguing with you...being harasses by that michael basciano guy... Just name something fair and lets get this over with.'

So not only did you completely change your stance on the solidity of HSV 1 and HSV 2 funtion, you've made it obvious that you still don't understand my point. I'm not saying that I have HSV 1 and it caused a genital herpes outbreak. I've never had a genital herpes outbreak. I'm saying it's possible I have HSV 2 and it caused an ORAL outbreak. That would explain why I only had one cold sore as a child. In the uncommon (though entirely possible) instance that a simplex affects the part of the body it is not common to, it generally causes less of a reaction (AKA one outbreak and you never see it again for the rest of your life...or no outbreak at all).

But you know what...I don't think you're an idiot like you're making yourself out to be. I've just realized this. I'm not giving you another e-mail to pretend you didn't read, so that you can drag this on for another week, while I wait for another friend or a family member to find that profile.

Your responsibilities for creating and maintaining a site like this were high. You did not meet them. You have proven a lack of due diligence in your initial seeking of medical knowledge for the accurate creating of this site. You are now proving a willful (and therefore malicious) twisting of medical facts I have shown you, for the purpose of saving yourself time and money, ignoring the harm it is doing to myself and others with profiles on your site.

You may consider this my official 998 demand. If you do not respond, this will arrive at your mailing address, certified. I am demanding not less than $150,000 in restitution for defamation of my character directly caused by the aforementioned lack of due diligence and malicious twisting of medical fact for profit. For each day after 12/15/09, $3,000 in penalties for damages shall be attached to this amount, with no limit. I hold the right to raise or lower this amount at any time.

As this is a business you are operating, it has also come to my attention that your actions fall under the purview of the Better Business Bureau. Your illegal methods of operating this site will be sent to them as a formal complaint. You should be hearing from the appropriate BBB figure shortly, if they do not decide to forward the complaint to local authorities.

I've done what you asked. You told me to do my research, and here it is for you. After you read this, I expect you to remove that profile and change how you handle genital herpes accusations and profile removal on your site.

They made sure to say "probably", because of the aforementioned point...that HSV 1 and HSV 2 can infect either area. You have no medical authority to tell me I have genital herpes based on a blood test. Nobody does. And as I told you before, I have no intention of getting a blood test to see if I have antibodies. My medical records will forever show that I have herpes, shooting up my health insurance premiums just because of a condition 80% of the public has, oral herpes (although this is beside the point, so please don't write back with an argument about whether my insurance premiums will go up).

Yes, if I were to test positive, it would mean I'm infected, but as you can clearly see, it would NOT mean I'm infected with GENITAL herpes, which is what that profile claims I have. I will now restate that I DO NOT RECEIVE OUTBREAKS IN MY GENITAL AREA (nor on my mouth or anywhere on my body). Therefore, I have no way to be tested for GENITAL herpes.

There was one instance last year when I did get a blister checked out by my doctor. I still have those results. The paper says specifically "no herpes simplex virus isolated". It is circled and dated, and the date is months AFTER the date this profile claims I was first infected.

I have now provided you medical proof from a source YOU told me you trust...showing that there is no plausible way for me to prove I DON'T have genital herpes.

Again, your continued support of this profile is now being considered harassment. My next letter to you will not be a simple demand for the removal of this profile. Should you choose to ignore this e-mail, I have no problem sending it to your mailing address, certified.
